By accessing or using Dental3DApp ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service. These terms apply to all users, including dental professionals, healthcare providers, and administrative staff.

2. Service Description

Dental3DApp is a HIPAA-compliant medical file sharing platform designed specifically for dental professionals. Our Service enables secure sharing of medical images, 3D scans, DICOM files, and other dental-related documents between authorized healthcare providers.

2.1 Core Services Include:

  • Secure file upload and storage with military-grade encryption
  • HIPAA-compliant sharing of medical files
  • Case management and patient record organization
  • Real-time collaboration between dental professionals
  • Automated PIN-based secure access for file recipients
  • Cloud-based storage with redundant backups

3. User Accounts and Registration

3.1 Account Creation

To use Dental3DApp, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

3.2 Professional Verification

Users must be licensed dental or healthcare professionals, or authorized staff working under their supervision. We reserve the right to verify professional credentials and may suspend accounts that cannot be verified.

4. Privacy and Data Protection

4.1 HIPAA Compliance

We maintain full HIPAA compliance in accordance with the Health Insurance Portability and Accountability Act. All patient data is encrypted at rest and in transit using AES-256 encryption.

4.2 Data Ownership

You retain all ownership rights to the content you upload. We claim no ownership of your files or patient data. You grant us only the limited rights necessary to provide the Service.

5. Acceptable Use Policy

5.1 Permitted Uses

  • Sharing medical files for legitimate healthcare purposes
  • Collaboration on patient treatment plans
  • Secure storage of dental records and imaging
  • Professional consultation and second opinions

5.2 Prohibited Uses

  • Sharing patient data without proper authorization
  • Using the Service for non-medical purposes
  • Attempting to breach security measures
  • Uploading malicious software or harmful content
  • Violating any applicable laws or regulations

6. File Storage and Limits

6.1 Storage Capacity

Each account includes storage capacity as specified in your subscription plan. Files up to 1GB per file can be uploaded. Larger files may require special arrangements.

6.2 File Retention

Files are retained according to your subscription terms and applicable healthcare regulations. We recommend maintaining independent backups of critical patient data.

7. Security Measures

We implement industry-leading security measures including:

  • 256-bit AES encryption for all data
  • Multi-factor authentication options
  • Regular security audits and penetration testing
  • Secure data centers with redundant backups
  • Automatic session timeout for inactive users
  • Audit logs for all file access and modifications

8. Service Level Agreement

8.1 Availability

We strive to maintain 99.9% uptime for the Service. Scheduled maintenance will be announced in advance when possible.

8.2 Support

Technical support is available to all users during business hours. Priority support is available for premium subscribers.

9. Fees and Payment

9.1 Subscription Plans

Dental3DApp offers various subscription tiers. Fees are billed monthly or annually as selected. All fees are non-refundable except as required by law.

9.2 Free Trial

New users may be eligible for a free trial period. Trial terms and limitations will be clearly communicated during registration.

10. Intellectual Property

The Dental3DApp platform, including its design, features, and documentation, is protected by copyright and other intellectual property laws. You may not copy, modify, or reverse engineer any part of the Service.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Dental3DApp SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES.

12. Indemnification

You agree to indemnify and hold harmless Dental3DApp, its affiliates, and their respective officers, directors, employees, and agents from any claims arising from your use of the Service or violation of these terms.

13. Termination

13.1 Termination by You

You may terminate your account at any time through the account settings or by contacting support. Upon termination, your data will be retained for the period required by applicable regulations.

13.2 Termination by Us

We reserve the right to suspend or terminate accounts that violate these terms or for any other reason at our discretion with appropriate notice.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

15. Changes to Terms

We may update these Terms from time to time. Significant changes will be notified via email or through the Service. Continued use after changes constitutes acceptance of the new terms.
